First off, I do not paint for and never intended it to be, a business. I paint because I want to, and love what I do. I've been told I'm a good painter and have sold a few paintings. Because people are asking how to purchase a painting from me, this website has come to be. There are a few rules that you must follow when using our Website, so we ask you to read these Terms and Conditions carefully.
(Please note my use of ‘Í’, ‘my’, ‘our‘, ‘we’, ‘us’ throughout this document means me, the artist).
Other than any picture specifically excluded, all the paintings on this website are original works painted by me and I retain copyright to them. This means you are not able to copy them or reproduce them for any commercial purposes. You have no resale rights to any part without exception.
You have a limited licence to access and make personal use of this Website. This does not allow you to download or modify any portion of the website (other than page caching), except with our express written consent.
3. Payment (for orders:
My preferred method of payment is Stripe. I'm not a big corporation so I have no facility to receive credit card payments over the Internet. The shopping cart is set up for Stripe only. This is a very secure method of payment and allows you to use a credit card without us ever knowing the card details, which is best for both of us. However, if you wish to buy a painting with an alternative method of payment, I will consider it. Send me your proposal to my email address (firstname.lastname@example.org). I do not accept any crypto currency transactions.
When you place a purchase order from the website, we will within 3 business days send you an email to the email address you have specified on your order, confirming the details of your order. This email may include shipping details if we have shipped your painting. Each original painting will be accompanied by a Certificate of Authenticity.
5. Packing & Handling:
All paintings are priced to include packing and shipment costs for delivery to your specified delivery address. We do not ship to Post Office boxes. Paintings are wrapped in 35 micron Ldpe bags packed in heavy quality corrugated board and clear bundling film to ensure maximum protection during shipping.
Shipping costs are included in your purchase price. We will endeavour to ship your painting within 5 business days following receipt of your order. We will send you an email to confirm shipment, together with tracking information and estimate of delivery time.
7. Shipping Within Australia:
Shipping is free Australia wide. The price you see on the checkout is all inclusive and there is no additional cost. Sales tax is included in the purchase price.
8. International Shipping:
The price you see on the checkout is all inclusive of packaging and handing and delivery, and there is no additional cost on our part. Your order will be fully insured against loss and damage for delivery to your specified delivery address. We do not ship to Post Office boxes. You will be responsible for any international custom/import fee and taxes. You should check with your country's customs offices regarding any additional costs that might be involved.
(a) Original Paintings - All purchases are final: we do not accept returns other than for damage caused during delivery of the painting, any shipping damage being insured against. My paintings shown in this website are photographed by me and my husband, Ron. We are not professional photographers. We post images to the website which we believe are a true representation of the original painting. However, in some light with some colours the pictured image may vary in intensity to the original. We ask that you take this into account before you place your order. We want you to have the artwork you love - one that fits your home or work space – so if you have any questions, please contact us before you place an order (email@example.com). (b) Merchandise - we accept returns and refunds on defective or damaged items, and where the product delivered is not as described or depicted on our website listing. Claims for returns and refunds must be made within 7 days of receipt of the item. The returned item must be sent back in its original packaging within 30 days of receipt, return shipment at buyer expense.
Please ensure that the details you provide us on your purchase order are correct and complete and inform us immediately of any changes. We will advise you in advance of any unexpected delay in delivery as estimated in our original shipping advice. For us to lodge an Insurance claim on your behalf you must advise us (firstname.lastname@example.org) within 7 days after our estimated delivery time if you have not received your painting.
11. Insurance Claims:
I’ve not ever had one, but this is how I think it will go if it ever does happen. Firstly, we will handle the insurance claim on your behalf. When signing for your damaged delivery you must state clearly on the delivery note any visible damage. You need to immediately advise details of your claim to my email address (email@example.com), together with photographic evidence of damage sustained to the packaging and the painting, We will either refund you in full, or give you the option that I reproduce the original artwork to the best of my ability, or you purchase any other painting off this website - less 10% of the advertised price as some consolation for your loss. We may request that you return the damaged painting at our cost, together with original packaging.
Any personal Information we collect is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure. We will never sell or otherwise seek to monetise use of your email address or disclose it to anyone other than legally required. When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy it. However, it will be stored in client files which will be kept by us for a minimum of 7 years. You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. 13. Feedback and Complaints Policy
We welcome any comments about our service, so that we can improve what we are doing. Our aim is to deal with any problems quickly and fairly. If you have reason to complain about our service, please e-mail us (email@example.com) stating clearly that you are making a complaint. Alternatively, call us on the number stated on the Website and say that you wish to make a complaint. Our aim is to respond to your complaint within seven (7) working days, either resolving the complaint, or with a timescale for resolution.
I understand there are heaps of other things (in a legal sense) I should possibly be including here, but including this will take the fun out of it for us both. I believe I’ve covered everything that you may want to know about to reassure you I am honest in my intentions.
